In a wrongful death case, the personal representative of the estate of the deceased can file a lawsuit against those deemed responsible for the death. When a wrongful death lawsuit is settled before going to trial, or when a judge or jury finds in favor of the plaintiff (the person who filed the lawsuit, usually a member of the deceased's family), the settlement or judgment obtained is intended to compensate the plaintiff for having to live without the deceased person.
The losses that may be recovered in a wrongful death case include medical and funeral expenses; compensation for the deceased person's pain and suffering if he or she was conscious between the time of injury and death; and losses suffered by the deceased person's spouse, children, or next of kin, including loss of financial support, parental training and guidance, and the society and companionship of the deceased person.
