Unfortunately, this is not the first shooting at this complex, located across the street from the Kensington MARTA transit station and near the DeKalb County jail complex. Our law firm represents another man who was shot at the same complex in 2007. That case was sued in the DeKalb State Court and is currently pending in the Supreme Court of Georgia on an issue that was raised before the trial of the case. The case is expected to be tried in 2013.

Although police have apparently released few details about this shooting, it will be interesting to find out whether the shooters and the victim were known to each other prior to the shooting and whether there were any security measures in place to deter this type of activity from occurring on the property.

Too often, owners have knowledge of previous criminal activity on their premises but fail to take adequate measures to prevent future crime. If you or a loved one are the victim of a crime on an apartment property, you may have a civil claim for damages against the owner of the property.
